Purchase terms and conditions
Purchase terms and conditions
1. General provisions
1.1. These Terms and Conditions of Purchase (the “Terms”) set out the procedure for buying goods in the online shop broliumedus.lt and its language versions broshoney.com, broshoney.lv and broshoney.ee (the “Online Shop”), as well as the rights, obligations and liability of the Buyer and the Seller.
1.2. The Seller is UAB “Brolių medus”, company code 306648882, VAT code LT100016761017, address Jaunimo g. 2A, Lukonių k., LT-40137 Kupiškio r., Lithuania. Email [email protected], tel. +370 641 67 623 (the “Seller”).
1.3. The Buyer is a natural person buying goods for purposes not related to their business or profession (a “consumer”), or a legal entity (together, the “Buyer”). Consumers enjoy the rights granted by the Civil Code of the Republic of Lithuania (the “Civil Code”) and other consumer protection legislation; these Terms do not limit those rights.
1.4. By placing an order, the Buyer confirms that they have read and accept these Terms. The Terms form part of the sales contract between the Buyer and the Seller.
1.5. The contract is concluded in the language in which the order is placed (Lithuanian, English, Latvian or Estonian).
2. Ordering and conclusion of the contract
2.1. Orders can be placed 24 hours a day, 7 days a week, with or without registering in the Online Shop.
2.2. The Buyer selects goods, adds them to the cart, enters delivery details and chooses the delivery and payment method. Before confirming the order, the Buyer sees the total price including VAT and the delivery price and can correct the entered details.
2.3. The contract is concluded when the Buyer confirms the order and the Seller sends an order confirmation to the email address provided by the Buyer. The confirmation contains the order details and a link to these Terms; we recommend keeping it.
2.4. If an ordered item is no longer available, the Seller informs the Buyer without delay and refunds the amount paid within 14 days or, with the Buyer’s consent, offers another item.
3. Prices
3.1. Prices are stated in euros and include VAT.
3.2. The delivery price depends on the delivery method and country and is shown before the order is confirmed.
3.3. The Buyer pays the price shown at the time the order is placed.
3.4. When a price reduction is announced, the prior price shown is the lowest price applied by the Seller during the 30 days before the reduction.
4. Payment
4.1. Payment is made through the Montonio payment system, by online banking or payment card.
4.2. Cash on delivery is also available where it is offered for the chosen delivery method. All available payment methods are shown when the order is placed.
4.3. Where payment is made in advance, the order is processed once payment is received.
4.4. A VAT invoice is issued at the Buyer’s request.
5. Delivery
5.1. We deliver to Lithuania, Latvia and Estonia.
5.2. Available delivery methods (e.g. LP Express or Venipak parcel lockers and couriers) and their prices are shown during checkout.
5.3. Delivery times are stated in the product description and at checkout (usually 1–3 business days in Lithuania). In any case, goods are delivered no later than 30 days after the contract is concluded, unless agreed otherwise.
5.4. The Buyer must provide an accurate delivery address or parcel locker, phone number and email address. If a parcel is not collected or must be re-sent because of inaccurate details, the Seller may ask the Buyer to cover the cost of re-sending.
5.5. If delivery is delayed due to circumstances beyond the Seller’s control, the Seller informs the Buyer without delay. If the goods are not delivered within the agreed or an additional period, the Buyer has the right to terminate the contract and receive a refund.
5.6. The risk of loss of or damage to the goods passes to the consumer when the consumer or a person designated by them (other than the carrier) receives the goods.
5.7. We recommend checking the packaging when collecting the parcel. If you notice damage, please note it on the carrier’s document or take photos and inform the Seller as soon as possible. This helps resolve the matter faster but does not limit the consumer’s rights under Section 7.
6. Right of withdrawal
6.1. The consumer has the right to withdraw from a contract concluded online within 14 calendar days without giving any reason. The period runs from the day the consumer or a person designated by them (other than the carrier) receives the goods; if goods from one order are delivered separately, from the day the last item is received.
6.2. To exercise this right, the consumer sends a clear statement to [email protected] before the period expires, stating the order number and the goods being returned. The model form in the Annex to these Terms may be used but is not mandatory. The deadline is met if the notice is sent before the period expires.
6.3. The consumer returns the goods no later than 14 days after notifying withdrawal, to Jaunimo g. 2A, Lukonių k., LT-40137 Kupiškio r., Lithuania, or in another way agreed with the Seller.
6.4. The consumer bears the direct cost of returning the goods.
6.5. The Seller refunds all payments received from the consumer, including the cost of delivery, no later than 14 days from the day the withdrawal notice is received. If the consumer chose a delivery method more expensive than the cheapest one offered by the Seller, the difference is not refunded. The Seller may withhold the refund until it has received the goods back or the consumer has supplied evidence of having sent them, whichever is earlier. The refund is made using the same payment method the consumer used, unless agreed otherwise; the consumer pays no fees for the refund.
6.6. The consumer is only liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.
6.7. Under Article 6.228(10)(2) of the Civil Code, the right of withdrawal does not apply, among others, to:
6.7.1. goods that are liable to deteriorate rapidly or have a short shelf life;
6.7.2. sealed goods that are not suitable for return for health protection or hygiene reasons if unsealed after delivery (e.g. opened jars or packages of honey and other food products);
6.7.3. goods made to the consumer’s specifications or clearly personalised (e.g. personalised gifts).
6.8. This Section applies to consumers. The return of defective goods is governed by Section 7.
7. Product quality and defective goods
7.1. Product characteristics are stated in the product descriptions. The colour of a product on screen may differ slightly from the actual colour depending on screen settings.
7.2. The best-before date of food products is shown on the packaging. The Seller sells goods so that the Buyer has a real opportunity to consume them before that date.
7.3. The Seller is liable for the conformity of the goods with the contract. If the consumer receives defective, damaged or wrong goods, they have the rights provided in Article 6.363 of the Civil Code: to request replacement, a price reduction, or to terminate the contract and receive a refund.
7.4. The Buyer reports a lack of conformity to [email protected] within a reasonable time after discovering it, stating the order number, briefly describing the problem and, if possible, attaching photos.
7.5. The Seller bears the cost of returning and replacing defective goods. If the contract is terminated, the amount paid, including delivery, is refunded no later than 14 days.
7.6. The Seller responds to the consumer’s claim in writing no later than 14 days after receiving it.
8. Personal data and account
8.1. The Buyer’s personal data (name, surname, address, phone number, email address) are processed to fulfil the order and for accounting purposes, as described in the Privacy Policy.
8.2. Newsletters and other marketing messages are sent only with the Buyer’s separate consent, which can be withdrawn at any time via the link in the message or by contacting the Seller. Messages related to order fulfilment are not marketing messages.
8.3. A registered Buyer keeps their login details safe, does not share them with others and informs the Seller without delay if they are lost. The Buyer updates their registration details if they change.
8.4. If the Buyer attempts to harm the operation or security of the Online Shop, the Seller may restrict or suspend their access to the Online Shop.
9. Promotions and gift vouchers
9.1. The terms and duration of promotions are published in the Online Shop. Changes apply only from the moment they are published and do not affect orders already confirmed.
9.2. The validity period and terms of use of a gift voucher are stated in the voucher description and on the voucher itself.
10. Customer reviews
10.1. The Online Shop publishes customer reviews of products. The “Reviews” menu link leads to the reviews on the Brolių medus Facebook page.
10.2. Reviews on product pages can only be left by buyers who purchased the product in the Online Shop; this is verified against order data. Facebook reviews are posted by users of that platform, and the Seller cannot verify whether they purchased the product.
10.3. All reviews are published, both positive and negative. The Seller does not pay for reviews or offer discounts or gifts in exchange for them.
10.4. The Seller may decline to publish or remove a review only if it contains offensive content, advertising, other people’s personal data, or is unrelated to the product. Reviews are not removed merely because they are negative.
10.5. At the Buyer’s request, the Seller provides further information on how reviews are handled.
11. Dispute resolution
11.1. If you have any questions or complaints, please contact the Seller at [email protected] or +370 641 67 623. The Seller replies within 14 days at the latest.
11.2. If the consumer is not satisfied with the Seller’s reply, they may use out-of-court consumer dispute resolution.
11.3. Disputes between consumers and sellers are resolved out of court by the State Consumer Rights Protection Authority of Lithuania (Goštauto g. 12, Vilnius, www.vvtat.lt). An application may be filed no later than one year after the consumer contacted the Seller.
11.4. Consumers living in other EU Member States (e.g. Latvia or Estonia) may also contact the European Consumer Centre in their country (ECC-Net), which helps resolve cross-border disputes free of charge.
11.5. If a dispute cannot be resolved in other ways, the consumer may bring it to court in accordance with the law.
12. Liability
12.1. The Buyer is responsible for the accuracy of the details provided. The Seller is not liable for consequences arising from inaccurate details provided by the Buyer.
12.2. A party in breach of the contract compensates the other party for direct losses in accordance with the law.
12.3. The Seller is not responsible for the content of third-party websites linked from the Online Shop.
12.4. The parties are released from liability if they fail to perform their obligations due to force majeure.
12.5. These Terms do not limit or exclude consumer rights granted by mandatory provisions of law.
13. Final provisions
13.1. These Terms are governed by the law of the Republic of Lithuania. This does not deprive the consumer of the protection afforded by the mandatory provisions of the law of the country of their habitual residence.
13.2. The Seller may amend these Terms. An order is governed by the version of the Terms in force when the order was placed.
13.3. These Terms are published in Lithuanian, English, Latvian and Estonian.
